TERMS AND CONDITIONS

 

Introduction

  1. Nunanny Connect (“Nunanny Connect”) is a service offering by Nunanny (Pty) Ltd (“Nunanny”) but is considered a separate service offering to that of Nunanny’s temporary and permanent placement offering.
  2. Nunanny Connect offers a data base of Nannies, Housekeepers and Night Nurses which clients can then search in order to hire any Nanny, Housekeeper or Night Nurse.
  3. If you would like to be listed on Nunanny Connect’s database, you will need to complete an application form and upload various supporting documentation.
  4. The fact that you submit your application means that you have read and agree to these terms and conditions. We therefore encourage you to ask any questions about these terms and conditions before you submit your application.
  5. “Candidate” or “Candidates” will mean you, once you have been listed on our online platforms and/or database.
  6. “Client” means any client of Nunanny Connect. Client may also include any person who finds you on the Nunanny Connect website and who then contacts you without purchasing your profile.
  7. “Platform” means any online location on which you or clients can make use of or enjoy Nunanny Connect’s services such as its website or through means such as WhatsApp, Form Stack, Google Drive, etc.
  8. “Profile” means your online profile that is available to clients on Nunanny Connect website and in the Nunanny Connect database. This includes all your information and any documents you uploaded as part of your application process such as your CV, references, certifications and/or qualifications or pictures.
  9. “Purchased Profile” means your profile with your contact details.
  10. “Screening” means the add-on service offer by Nunanny Connect which includes checking that the information you have provided to us is accurate. This may include us calling your references and confirming your certificates.
  11. “COVID-19” means the COVID-19 virus.
  12. Our Service to You
  13. If you accept our terms and conditions, you can apply to be listed on our database. This means that we will list you on our website and database.
  14. Your details will then available for our clients to view.
  15. This means that if a client is looking for a Nanny, Housekeeper or Night Nurse, they can view our website and can choose you.
  16. The client pays us if they want your contact details and we therefore do not charge you anything to list you on our website and database.
  17. Clients may also pay us to check that the information you have provided to us is true. This is called “Screening”.
  18. Importantly, we do not employ you. What we do for you is to list your profile on our website and assist clients in finding you if they want to employ you.
  19. If clients not to choose you, we will not be responsible for paying you any money.
  20. Application Process and Requirements
  21. If you are interested in becoming a Candidate on our website and database, you will be asked to complete an application form via WhatsApp or email.
  22. We will ask you to complete a series of questions so that we can find out as much about you and your experience as possible. The more we know about you, the more we can share with our clients and the more likely you are to be chosen.
  23. You will be allowed to send us or upload supporting documentation as part of your application. This may include things like your CV, references, qualifications, etc.
  24. Once we have completed the application form and given us copies of as much supporting documentation as possible (if applicable), we will put a profile together for you.
  25. Once we have everything we need and once we have put a profile together for you, we will list you on website where our clients can search for you.
  26. Honesty About the Information You Give Us
  27. You need to be completely honest with Nunanny Connect about any and all of the information you give us.
  28. We would rather have you tell us everything in the beginning than have to find out that something is untrue later. Honesty is always the best policy!
  29. If, for example, you do not have a work permit or your permit is expiring or you have completed a training course but haven’t paid your fees and therefore don’t have your certificate, then tell us that.
  30. We will double check the information you give us as part of one of the services we offer clients (called “screening”), so it is important that you provide accurate and honest information.
  31. We may verify information by, for example, phoning the training institute to double check any certificate you give to us, if applicable, so please rather be honest.
  32. If we find out that any of the information you have given to us is untrue, we may delist you from our platforms and may even sue you if we or our clients have lost money because of your dishonesty.
  33. Permission for Nunanny Connect to Use Your Personal Information
  34. In order to allow us to market you to our clients, we will need to gather and publish your personal information.
  35. This information may include your name, contact number, location, CV, references, employment history, qualifications and pictures.
  36. You hereby give us consent to use your personal information in order to market you on our website and other platforms.
  37. You further agree that we are allowed to give your personal information to our clients.
  38. If a client selects to have your profile screened, you hereby give us permission to follow up with any third party in order to verify that any of the information you have provided to us is true and correct.
  39. We will not use your personal information for any other reason than to market you and attempt to link you with Nunanny Connect clients, and from time to time we may WhatsApp/email/phone you to see if you would like to be part of 3rd party Customer Testing pilot projects for new products, and software.
  40. We assure you that your contact details are safe with us and will not be shared externally without your consent.  We will always ask you first if you would like to be part of them and obtain your clear consent prior.
  41. Protection of Nunanny Connect’s Interests
  42. Once we have listed you on our website and other platforms, you may not give any of your contact information to any of the clients who have looked at your profile on our platforms or work for any of our clients without our consent.
  43. We are trying to help you find an employer / clients and if you go around our backs and clients do not have to pay for your contact information then we will not be able to continue helping you or others as we will not make any money.
  44. We therefore ask that if a client wants to employ you and mentions that they have gone through Nunanny Connect and you know that they did not get your contact information from Nunanny Connect that you please let us know.
  45. We will not hold you responsible if this happens but will only try to get payment out of the client.
  46. We will hold you responsible if you intentionally try to be employed by Nunanny Connect’s clients without them having to pay for Nunanny Connect’s service. This may mean that we will exclude you from our platform.
  47. Nunanny Connect Does Not Employ You
  48. Nunanny Connect’s service involves marketing your information to clients.
  49. We do not guarantee that any client will select or need you.
  50. We therefore do not guarantee any employment or that you will make any money from being listed with us.
  51. Nunanny Connect does not place you with clients. We provide clients with your information and it is up to the client to contact you if he or she wants to do so.
  52. If a client contacts you, they become your employer whether it is for one day, one week, one month or one year.
  53. The client will therefore be solely responsible if they do not follow the rules of the labour laws including the Basic Conditions of Employment Act and the Labour Relations Act.
  54. If you are not happy about the way in which the client has handled you then you will need to refer your dispute to the Commission for Conciliation, Mediation and Arbitration (“CCMA”). Nunanny Connect cannot help you if the client has done something that you are not happy with.
  55. However, we would like you to let us know if the client has done something that is wrong so that we can try and protect our other Candidates from this client. We may then block the client form our system but, unfortunately, cannot help you or make the client do what is right. You must rather go to the CCMA.
  56. Given that we only market your information and do not place you with clients, you hereby agree that Nunanny Connect (and in turn Nunanny) cannot be held responsible for anything that a client does wrong in terms of your employment with that client.
  57. Confidentiality
  58. These terms and conditions are confidential and should only be shared between you and Nunanny Connect.
  59. You agree to keep all information related to these terms and conditions confidential, meaning secret. You will therefore not share any of the information about the application process, about clients or about Nunanny Connect with other people without our permission.
  60. That said, feel free to tell you Nanny friends about us so that we can get them onto our database as well.
  61. Acceptance of Terms and Conditions
  62. By signing these terms and conditions you agree to everything that is contained in them.
  63. These terms and conditions cannot be changed unless we put the changes in writing and ask you to sign again.
